Illegal cigarettes lead to £8,000 fine for Grays shopkeeper

A GRAYS shopkeeper has been fined over £8,000 due to a number of offences in relation the sale of cigarettes.

Rober Raza, aged 25, of Home Mead Close, Gravesend pled guilty to the following charges when the case was presented at Basildon magistrates court.

The charges were brought by Thurrock Council.

Raza was fined a total of £8,259.00.

1. On or about 04/07/2016 at Monika’s Mini Mart, 2b High Street, Grays supplied a tobacco product for smoking, namely one pack of 20 Marlboro Gold and one pack of 20 NZ Gold Super Slims, the unit pack of which did not carry a combined health warning as required by regulation 5 of the Tobacco and Related Products Regulations 2016, in that there was no health warning.

2. On or about 29/07/2016 at Monika’s Mini Mart, 2b High Street, Grays supplied a tobacco product for smoking, namely one pack of 20 Marlboro Gold and one pack of NZ Gold Super Slims, the unit pack of which did not carry a combined health warning as required by regulation 5 of the Tobacco and Related Products Regulations 2016, in that there was no health warning. Contrary to regulations 5, 48(a)(i) and 51 of the Tobacco and Related Products

On or about 05/09/2016 at Monika’s Mini Mart, 2b High Street, Grays supplied a tobacco product for smoking, namely 323 assorted packets of cigarettes and 24 pouches of tobacco, the unit pack of which did not carry a combined health warning as required by regulation 5 of the Tobacco and Related Products Regulations 2016, in that there was no health warning. Contrary to regulations 5, 48(a)(i) and 51 of the Tobacco and Related Products Regulations 2016 and section 2(2) of the European Communities Act 1972.

4. On or about 05/09/2017 Mr Robert Raza, trading as Monika’s Mini Mart, 2b High Street, Grays, Essex RM17 6LU, in the course of business displayed tobacco products or caused tobacco products to be displayed. Contrary to section 7A of the Tobacco Advertising and Promotion Act 2002

5. On or about 05/09/2016 at 2b High Street, Grays while carrying on a business at Monika’s Mini Mart, which involved the sale of tobacco by retail failed to exhibit at that location a notice as required by regulation 4 of the Children and Young Persons (Protection from Tobacco) Regulations 1991. Contrary to section 4 of the Children and Young Persons (Protection from Tobacco) Act 1991.

6. On or about 05/09/2016 at 2b High Street, Grays the defendant while carrying on a business at Monika’s Mini Mart, which involved the sale of tobacco by retail failed to exhibit at that location a notice as required by regulation 4 of the Children and Young Persons (Protection from Tobacco) Regulations 1991.

7. On or about 05/09/2016 at Monika’s Mini Mart, 2b High Street, Grays with a view to gain for yourself or another, or with intent to cause loss to another, and without the consent of the proprietor, had in your possession, custody or control in the course of business, goods, namely 23 packets of cigarettes, which bore, or the packaging of which bore, a sign identical to, or likely to be mistaken for, a registered trade mark, namely the ‘L&M’ marks and logo, with a view to you or another selling the said goods. Contrary to section 92(1)(c) and (6) of the Trade Marks Act 1994.

8. On or about 05/09/2016 at Monika’s Mini Mart, 2b High Street, Grays with a view to gain for yourself or another, or with intent to cause loss to another, and without the consent of the proprietor, had in your possession, custody or control in the course of business, goods, namely 40 packets of cigarettes, which bore, or the packaging of which bore, a sign identical to, or likely to be mistaken for, a registered trade mark, namely the ‘Mayfair’ marks and logo, with a view to you or another selling the said goods. Contrary to section 92(1)(c) and (6) of the Trade Marks Act 1994.

9. On or about 05/09/2016 at Monika’s Mini Mart, 2b High Street, Grays, being a distributor, in failing to act with due care in order to help ensure compliance with the applicable safety requirements, exposed for supply a product, namely 23 packets of L&M Red Label cigarettes, 25 packets of Marlboro Gold cigarettes and 40 packets of Mayfair Kingsize cigarettes, which you knew, or should have presumed, on the basis of the information in your possession and as a professional, was a dangerous product.

10. On or about 01/11/2016 at Monika’s Mini Mart, 2b High Street, Grays supplied a tobacco product for smoking, namely one pack of 20 Marlboro Gold and one
